Peraturan ini dapat diakses pada laman <a href=\"https:\/\/jdih.setkab.go.id\/\">JDIH Sekretariat Kabinet.<\/a><\/p>\n<p style=\"text-align: justify;\">Disebutkan dalam pertimbangan Perpres yang ditandatangani Presiden Jokowi pada tanggal 10 November ini, penyebaran <em>Corona Virus Disease<\/em> 2019 (COVID-19) telah dinyatakan oleh <em>World Health Organization<\/em> (WHO) sebagai <em>global pandemic<\/em> dan pemerintah telah pula menetapkan bencana nonalam penyebaran COVID-19 sebagai bencana nasional.<\/p>\n<p style=\"text-align: justify;\">\u201cBahwa sehubungan dengan kebutuhan yang sangat mendesak dalam upaya penanggulangan penyakit COVID-19 di Indonesia, perlu menetapkan kebijakan akses terhadap obat Remdesivir yang saat ini masih dilindungi paten,\u201d bunyi pertimbangan berikutnya.<!--more--><\/p>\n<p style=\"text-align: justify;\">Selanjutnya disebutkan, berdasarkan ketentuan Pasal 109 ayat (3) Undang-Undang (UU) Nomor 13 Tahun 2016 tentang Paten sebagaimana telah diubah dengan UU Nomor 11 Tahun 2020 tentang Cipta Kerja, pelaksanaan paten oleh pemerintah ditetapkan dengan Perpres.<\/p>\n<p style=\"text-align: justify;\">Ditegaskan pada Pasal 1, pemerintah melaksanakan paten terhadap obat Remdesivir. Pelaksanaan paten tersebut untuk memenuhi ketersediaan dan kebutuhan yang sangat mendesak untuk pengobatan penyakit COVID-19.<\/p>\n<p style=\"text-align: justify;\">Pelaksanaan paten dilaksanakan untuk jangka waktu tiga tahun sejak Perpres ini mulai berlaku. Apabila setelah jangka waktu tersebut pandemi belum berakhir, pelaksanaan paten oleh pemerintah diperpanjang sampai dengan pandemi COVID-19 ditetapkan berakhir oleh pemerintah.<\/p>\n<p style=\"text-align: justify;\">\u201cPelaksanaan paten oleh pemerintah terhadap obat Remdesivir memuat nama zat aktif, nama pemegang paten, nomor permohonan paten\/nomor paten, dan judul invensi sebagaimana tercantum dalam lampiran yang merupakan bagian tidak terpisahkan dari Peraturan Presiden ini,\u201d bunyi Pasal 2.<\/p>\n<p style=\"text-align: justify;\">Ditegaskan pada Pasal 3, menteri yang menyelenggarakan urusan pemerintahan di bidang kesehatan menunjuk industri farmasi sebagai pelaksana paten obat Remdesivir untuk dan atas nama pemerintah sesuai dengan ketentuan peraturan perundang-undangan. Industri farmasi dimaksud melaksanakan tugas sebagai pelaksana paten obat Remdesivir secara terbatas, untuk memenuhi kebutuhan dalam negeri, dan bersifat nonkomersial.<\/p>\n<p style=\"text-align: justify;\">Industri farmasi tersebut wajib memenuhi persyaratan, yaitu memiliki fasilitas dan mampu melaksanakan paten; tidak mengalihkan pelaksanaan paten dimaksud kepada pihak lain; dan memiliki cara produksi yang baik, peredaran, dan pengawasan sesuai dengan ketentuan peraturan perundang-undangan.<\/p>\n<p style=\"text-align: justify;\">\u201cIndustri farmasi sebagaimana dimaksud dalam Pasal 3 memberikan imbalan kepada pemegang paten sebesar satu persen dari nilai jual neto obat Remdesivir,\u201d ditegaskan pada Pasal 4.<\/p>\n<p style=\"text-align: justify;\">Selanjutnya, dijelaskan pada Pasal 5, pemberian imbalan sebagaimana dimaksud dilaksanakan setiap tahun sesuai jangka waktu.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/jdih.setkab.go.id\/PUUdoc\/176565\/Salinan_Perpres_Nomor_100_Tahun_2021.pdf\">Perpres Nomor 100\/2021<\/a> ini mulai berlaku sejak diundangkan oleh Menteri Hukum dan Hak Asasi Manusia Yasonna H.
