President Joko \u201cJokowi\u201d Widodo on 13 October 2020 signed Government Regulation (PP) Number 60 of 2020 on the Disability Service Unit on Manpower.<\/p>\n

The Regulation is a mandate from Law Number 8 of 2016 on Persons with Disabilities, and shows the Government’s commitment to respect, protect and fulfill the rights of Persons with Disabilities.<\/p>\n

“Person with Disabilities is every person who has physical, intellectual, mental, and\/or sensory limitations for a long period of time and experience obstacles and difficulties to participate fully and effectively with other citizens based on equal rights,” Article 1 of the Regulation reads.<\/p>\n

The Regulation, which can be accessed on jdih.setkab.go.id<\/a>, regulates resources, duties, monitoring and evaluation, reporting, guidance and supervision, as well as funding for the Disability Service Unit (ULD) on Manpower.<\/p>\n

The Regulation stipulates that regional governments are obliged to have a Disability Service Unit on Manpower. The Unit is managed by the agency that carries out regional governments affairs in the manpower sector in province and regency\/city. “The Disability Service Unit is managed through strengthening the duties and functions of agency that carries out regional governments affairs in the manpower sector in province and regency\/city,” Article 3 paragraph (1) of the Regulation states.<\/p>\n

The Unit consists of coordinator, secretary, and ex-officio members. “Membership of the Disability Service Unit is determined by the Governor or Regent\/Mayor in accordance with their authority,” Article 3 paragraph (4) reads.<\/p>\n

The regional governments provide human resources to the Disability Service Unit. The Human resources must possess knowledge, skills, ethics and sensitivity in serving persons with disabilities. “Human resources at the Disability Service Unit include: a. Government employees who work in the agency that carries out regional governments affairs in the manpower sector in province and regency\/city; and b. assistants for Persons with Disabilities,\u201d Article 5 paragraph (2) of the Regulation states.<\/p>\n

Facilities and infrastructure for the Unit are provided for easy services and access for Persons with Disabilities. Article 7 paragraph (2) of the Regulation states that the facilities and infrastructure must include standardized service rooms which are easily accessible to carry out the Unit services; easily accessible facilities in the employment service room for Persons with Disabilities; and other supporting facilities.<\/p>\n

“The Disability Service Unit duties include: a. plan for Accommodations, Protection, and Fulfillment of the rights to work for Persons with Disabilities; b. providing information to the Government, regional governments, and private companies regarding the process of recruitment, job training, job placement, job continuity, and career development that is fair and without discrimination for Persons with Disabilities; c. providing assistance to workers with disabilities; d. providing assistance to employers who employ workers with disabilities; and e. coordinating the Disability Service Unit, employers, and workers in the fulfillment and provision of work aids for Persons with Disabilities,” Article 8 of the Regulation states.<\/p>\n

According to the Regulation, the Government and regional governments must conduct monitoring and evaluation of the implementation and performance of the Disability Service Unit. “The monitoring and evaluation are carried out as a form of accountability and quality control in accommodating, protecting and fulfilling the rights to work for Persons with Disabilities,” Article 14 paragraph (2) of the Regulation reads.<\/p>\n

The Disability Service Unit must report the implementation of activities to Governors and Regents\/Mayors. “Governors and Regents\/Mayors are obliged to submit a report on the implementation of the Disability Service Unit to the Minister who carries out Government affairs in the manpower sector,” Article 15 paragraph (2) of the Regulation reads.<\/p>\n

The Regulation stipulates that the funding for the implementation of the Unit activities is provided by the State Budget (APBN), Regional Budget (APBD), and other legal and non-binding sources in accordance with the provisions of laws and regulations.<\/p>\n

“The Government Regulation shall come into force as of the date of its promulgation,” Article 18 of the Regulation reads. The Regulation was promulgated in Jakarta, 13 October 2020 by Minister of Law and Human Rights of the Republic of Indonesia Yasonna H. Laoly. (SM\/UN)<\/strong><\/p>\n
