Gov’t Issues Regulation on Head of BP Batam

In a bid to develop Batam Free Trade and Free Port Area (BP Batam),  the Government has stipulated provisions on the requirements and duties for the Head of the BP Batam.

Thus, on 11 September 2019, President Joko “Jokowi” Widodo signed Government Regulation (PP) Number 62 of 2019 on Second Amendment to Government Regulation Number 46 of 2007 on Batam Free Trade and Free Port Area.

The regulation states that BP Batam activities in the economic sector including trade, maritime, industry, transportation, banking, tourism, logistics, technology development, energy, health and pharmaceutical sectors, and other fields.

Those activities which are related to the development of public infrastructure and public interest, according to the PP, are carried out based on joint planning with the Batam City Government.

“The joint planning is coordinated by the Board of the Batam Free Trade and Free Port Area,” Article 2 paragraph (5) of the PP states.

According to the regulation, the Mayor of Batam is ex-officio Head of the BP Batam. The Mayor must meet the following requirements: a. not in prison; or b. shall not be in the interim, in accordance with the provisions of the Legislature of the Regional Government.

“The Board of the Batam Free Trade and Free Port Area shall appoint Mayor of Batam, who meets the requirements, as the Head of the Batam Free Trade and Free Port Area in accordance with the provisions of Laws and Regulations,” Article 2a paragraph (1c) of this regulation states.

The term of office of the Head of the BP Batam, according to this PP, follows the provisions of the Law on Free Trade and Free Port Area and the Law on Regional Government.

In the event that the Mayor of Batam does not meet the requirements as referred to the regulation, the duties and authority of the Head of the BP Batam will be carried out by the Deputy Head of the BP Batam.

The Head of the BP Batam, said the PP, is the budget/goods user at the BP Batam.

Furthermore, the Board of the BP Batam has the authority to stipulate general policies, foster, supervise, evaluate the achievement of performance agreements, and coordinate the activities of the BP Batam in accordance with the provisions of the Laws and Regulations.

Provisions on the exercise of authority as referred to in this PP are determined by the Regulations of Chairperson of the Board of the BP Batam.

“This Government Regulation shall apply as of the date of its promulgation,” Article II of the Government Regulation which was promulgated by Minister of Law and Human Rights Yasonna H. Laoly on 17 September 2019 reads. (Pusdatin/ES)
