BKN: CPNS Entitled to Maternity Leave
The National Civil Servant Agency (BKN) reaffirms that Civil Servants Candidates (CPNS) are entitled to maternity leave. Nevertheless, the CPNS must also meet the mandatory requirements to undergo a probation period of 1 (one) year.
“Maternity leave for CPNS is authorized by Personal Supervisor Officer (PPK) by taking into account the obligation of CPNS to undergo a probation period of 1 (one) year and a letter from a doctor/hospital to ensure that the CPNS has the right to maternity leave and can still fulfill the mandatory requirements to undergo probation period for 1 (one) year,” LAPORBKN! Application Administrator Imma Gayatri Retnaningrum said when answering public questions on maternity leave for CPNS via LAPOR! application, last weekend.
Imma added that the regulation refers to Article 340 of Government Regulation Number 11 of 2017 on Civil Servant Management which states that provisions regarding sick leave, maternity leave, and leave for important reasons apply mutatis mutandis to CPNS, “It means that CPNS is entitled to maternity leave,” she said.
Imma went on to say that Article 34 paragraph (1), paragraph (2), paragraph (3), paragraph (4), and paragraph (5), Article 36 paragraph (1) letter (a) of Government Regulation Number 11 of 2017 stipulate that:
- CPNS must undergo a trial period of 1 (one) year;
- The probation period as referred to in paragraph (1) is a pre-service period;
- The pre-service period as referred to in paragraph (2) is carried out through a process of education and training;
- The education and training process as referred to in paragraph (3) is carried out in an integrated manner to build moral integrity, honesty, enthusiasm, spirit of nationalism, competitiveness, responsibility, professionalism, and technical competencies;
- Education and training as referred to in paragraph (4) can only be conducted in 1 (one) time;
- CPNS who are appointed as PNS (Civil Servant) must meet the requirements of passing education and training as referred to in Article 34.
Imma further said that CPNS must undergo a period of probation or pre-service for 1 (one) year; the pre-service period is carried out through an education and training program that can only be conducted once; and CPNS are entitled to maternity leave. The maternity leave is authorized by PPK, by taking into account a letter from doctors/hospitals and the obligation of CPNS to undergo probation.
She added that maternity leave for CPNS is regulated in Government Regulation Number 11 of 2017 on Civil Servant Management Article 325 paragraph (3), Article 326 paragraph (1) and paragraph (2), and Article 340 which state:
- The duration of maternity leave is 3 (three) months;
- In order to be able to get maternity leave as referred to in paragraph (1), the relevant civil servant should submit a written proposal to the PPK or the officials who have authority to approve the right to maternity leave;
- The right to maternity leave as referred to in paragraph (2) is given in writing by the PPK or the officials who have authority to approve the right to maternity leave;
- Provisions regarding sick leave, maternity leave, and leave for important reasons apply mutatis mutandis to CPNS. (BKN Public Relations/ES)
