Education Ministry Issues Regulation to Ease Contract Teachers Payment during COVID-19 Outbreak

The Ministry of Education and Culture has issued Regulation of Minister of Education and Culture Number 19 of 2020 on Amendment to Regulation of Minister of Education and Culture Number 8 of 2020 on Technical Guidance for Regular School Operational Assistance (BOS).

In the new Regulation, the Ministry of Education and Culture abolishes the provisions on the Unique Number of Teachers and Education Personnel (NUPTK) as one of the requirements for contract teachers to be able to receive salaries from the BOS fund.

The Regulation states that the policy is temporary and it applies during the COVID-19 emergency status. The provision for the use of the Regular BOS fund is valid from April 2020 until the revocation of the emergency status by the Central Government.

Minister of Education and Culture Nadiem Makarim said that in the previous Regulation, namely the Regulation of Minister of Education and Culture Number 8 of 2020 on Regular BOS Technical Guidance, the NUPTK is a requirement for payment of contract teacher salaries using the BOS fund.

“Now, during the Covid-19 emergency period, we change the provision. We abolish the requirement of having the NUPTK. However, contract teachers who are entitled to receive salary from the BOS fund must still be listed in the Center for Education Data (Dapodik) as of December 2019. The other requirements still apply, including that the teachers have not received professional allowances and have fulfilled the minimum teaching hours,” the Minister said via teleconference on Wednesday (15/4).

Article 9A paragraph 3 of the Regulation of Minister of Education and Culture Number 19 of 2020 states that the salary is given to the teachers who are not state civil apparatus and who meet the following requirements: a. being registered in the Dapodik as of 31 December 2019, b. have not received a professional allowance, and c. fulfilling the minimum teaching hours, including teaching from home during the COVID-19 Public Health Emergency status established by the Central Government.

The Minister said that the policy is issued to support the contract teachers during the COVID-19 outbreak. In addition to removing the NUPTK requirement, the Ministry of Education and Culture also abolishes the previous 50% cap of the BOS fund allocation for the contract teachers payment.

“Because the economy is being affected, we abolish some provisions and allow school principals to pay salariy to the contract teachers. We want to show that there are ways to ensure the welfare of the contract teachers during this crisis,” the Minister said.

He also reiterated that school principals has discretion in using the BOS funds because a school principal is a person who knows best about the operational needs of the school and the needs of the teachers.

“The point is that during this crisis we want to support school principals and those in need, so they can use the BOS fund as flexible as possible to support the online learning,” the Minister said (PR of Ministry of Education and Culture/EN)
