Functional Positions Management Must Comply with Ministerial Regulation: Gov’t Officials

Ministry of State Apparatus Empowerment and Bureaucratic Reforms has stated that all functional positions in Government Institutions must comply with Regulation of Minister of State Apparatus Empowerment and Bureaucratic Reforms Number 13/2019 on the Proposal, Determination and Development of Functional Positions for Civil Servants.

“All existing functional positions must be evaluated based on Regulation of Minister of State Apparatus Empowerment and Bureaucratic Reforms Number 13/2019,” the acting Deputy for Apparatus Human Resources of Ministry of State Apparatus Empowerment and Bureaucratic Reforms Teguh Widjinarko said during the Coordination Meeting on the Functional Position Development in Jakarta, Friday (05/03/2021).

In the meantime, the Ministry’s Assistant Deputy for Standardization of Position and Competence of Human Resources Istyadi Insani said that the adjustment of regulation for functional positions in accordance with the aforementioned Ministerial Regulation must be carried out no later than 30 July 2022.

Istyadi said that the urgency of the adjustments is because there are several functional positions established before the issuance of Law Number 5 of 2014 on State Civil Apparatus and Government Regulation Number 11 of 2017 on Management of Civil Servants as amended by Government Regulation Number 17 of 2020.

He went on to say that the adjustments that must be carried out immediately by the Fostering Agencies (the Government Institutions that have authority to develop functional officials) are positions, job descriptions, credit score determination, credit score assessment, temporary termination, functional position performance appraisal flow scheme, credit score addition, and other substantive matters.

The Fostering Agencies that have finished making revisions, he added, should immediately formulate new technical guidelines regulating the transition period for the implementation of the integrated credit score system.

Istyadi underscored that the Fostering Agencies that have not made adjustments to the Regulation of State Apparatus Empowerment and Bureaucratic Reforms Number 13/2019 by the deadline will face the consequences.

“Ministry of State Apparatus Empowerment and Bureaucratic Reforms will issue a circular regarding the consequences,” he said.

On the same occasion, the acting Director for State Civil Apparatus (ASN) of the National Civil Service Agency (BKN) Herman said that the BKN will draw up operational guidelines and technical instructions on the development of functional positions.
