Gov’t Dissolves Nine Non-structural Institutions

Dewan-Kelautan-300x225In a bid to improve effectiveness and efficiency of state administration tasks, President Joko “Jokowi” Widodo on 30 December 2016 signed a Presidential Regulation Number 116 of 2016 on the Dissolving of National Seed Board; Community Guidance Controlling Board; Council of the Stabilisation of Monetary and Economic Resilience; Steering Committee for the Development of Batam, Bintan, and Karimun Special Economic Zones;  National Team for Standardization of Geographical Names; Indonesian Maritime Council; National Council for Free Trade Area and Free Port; Coordinating Board for Spatial Development Planning; and Indonesian National Commission on Zoonosis Control.

The Presidential Regulation states that:

  1. tasks and functions of National Seed Board will be carried out by ministries responsible for Government affairs in the field of agriculture;
  2. tasks and functions of Community Guidance Controlling Board will be carried out by ministries responsible for Government affairs in the field of agriculture;
  3. tasks and functions ofCouncil of the Stabilisation of Monetary and Economic Resilience will be carried out by ministries which conduct ministry’s synchronization and coordination functions in the field of economy;
  4. tasks and functions ofSteering Committee for the Development of Batam, Bintan, and Karimun Special Economic Zones will be carried out by non-structural institutions with the duty and authority to manage, develop, and build free trade areas and free ports in Batam, Bintan and Karimun Islands;
  5. tasks and functions ofNational Team for Standardization of Geographical Names will be carried out by non-ministerial Government institutions responsible for Government affairs in the field of geospatial;
  6. tasks and functions ofIndonesian Maritime Council in assessment and advisory, policy recommendations, monitoring, as well as evaluation will be carried out by ministries responsible for Government affairs in the field of maritime and fisheries, while tasks and functions of Indonesian Maritime Council in consultation for policies integration will be carried out by ministries which conduct ministry’s synchronization and coordination functions in the field of maritime;
  7. tasks and functions ofNational Council for Free Trade Area and Free Port will be carried out by non-structural institutions with the duty and authority to develop the special economic zones;
  8. tasks and functions ofCoordinating Board for Spatial Development Planning will be carried out by ministries responsible for Government affairs in the fields of agrarian and spatial planning; and
  9. tasks and functions ofIndonesian National Commission on Zoonosis Control will be carried out by ministries responsible for Government affairs in the fields of development and cultures.

“By following the dissolving as intended, the matters of financing, employees, equipment, and documents of the 9 (nine) non-structural institutions mentioned will be transferred to the ministries/institutions as referred,” Article 3 paragraph (1) of the Presidential Regulation says.

The process of dissolving those institutions will be conducted under the coordination of Minister of State Apparatus Empowerment and Bureaucratic Reforms and involves National Civil Service Agency, Development Finance Comptroller (BPKP), National Archive Agency (ANRI), and Ministry of Finance.

“The dissolving as intended shall be completed no later than 1 (one) year after the enactment date of this Presidential Regulation,” Article 3 paragraph (3) of the Presidential Regulation says.

Financing for those 9 (nine) non-structural institutions will be imposed to the State Budget (APBN).

With the enactment of this Presidential Regulation, then: a. Presidential Decree Number 27 of 1971 on National Seed Board; b. Presidential Regulation Number 40 of 1997 on Community Guidance Controlling Board; c. Presidential Decree Number 17 of 1998 on Council of the Stabilisation of Monetary and Economic Resilience; d. Presidential Decree Number 12 of 2006 on Steering Committee for the Development of Batam, Bintan, and Karimun Special Economic Zones; e. Presidential Regulation Number 112 of 2016 on  National Team for Standardization of Geographical Names; f. Presidential Decree Number 21 of 2007 on Indonesian Maritime Council; g. Presidential Regulation Number 30 of 2008 on National Council for Free Trade Area and Free Port; h. Presidential Decree Number 4 of 2009 on Coordinating Board for Spatial Development Planning; and i. Presidential Regulation Number 30 of 2011 on Indonesian National Commission on Zoonosis Control, shall be revoked and declared no longer valid.

“This Presidential Regulation shall apply as of the date of its enactment” Article 6 of the Presidential Regulation Number 116 of 2016 which is promulgated by the Ministry of Law and Human Rights Yasonna H. Laoly on 30 December 2016 says. (Pusdatin/ES) (RAS/EP/YM/Naster)
