Gov’t Issues Regulation on Holiday Allowance, Salary Bonus for State Apparatus

President Joko “Jokowi” Widodo has issued Government Regulation (PP) Number 15 of 2023 on Provisions of the 2023 Religious Holiday Allowance and the 13th Month Salary Bonus for State Civil Apparatus, State Pensioners, and Allowance Beneficiaries.

Religious Holiday Allowance (THR) and 13th month salary bonus of 2023 are aimed at maintaining people’s purchasing power through the spending made by state apparatus, state pensioners, pension recipients, and allowance beneficiaries that will contribute to the public and stimulate the national economy.

“To increase the spending of state apparatus, state pensioners, pension recipients, and allowance beneficiaries, the government provides religious holiday allowance and the 13th Month Salary Bonus as a form of appreciation to the state civil apparatus for their dedication to the state and the nation,” stated in the regulation signed by President Jokowi on March 29, 2023 and can be accessed on the JDIH Cabinet Secretariat page.

Article 5 of this regulation emphasized that THR and the 13th month salary bonus are given to all state apparatus (PNS), military personnel, and police officers, excluding:

  1. Those on unpaid leave and the like; or
  2. Those assigned to non-government agencies either at home or foreign countries whose salary is paid by the agency where the assignment is based in accordance with the provisions of laws and regulations.

The allowance and bonus given to state civil apparatus, Contract-based Government Employees (PPPK), military personnel and police officers, government officials, Supervisory Board of the Corruption Eradication Commission (KPK), leaders of Public Broadcasting Institutions, and Non State Civil Apparatus Employees assigned to Public Broadcasting Institutions, which the budget is sourced from the State Budget (APBN),comprise:

  1. basic salary;
  2. family allowance;
  3. food allowance;
  4. structural and functional allowance or general position allowance; and
  5. 50 percent of performance allowance based on their positions, ranks, or ranks of office.

On the other hand, the allowance and bonus given to state civil apparatus and PPPK, which the budget is sourced from the Regional Budget (APBD), comprise;

  1. basic salary;
  2. family allowance;
  3. food allowance;
  4. structural and functional allowance or general position allowance; and
  5. additional income of 50 percent at maximum for regional government institutions which will be given based on their positions, ranks, or ranks of office, in accordance with the financial ability of the region and provisions of laws and regulations.

PP 15/2023 also regulates THR and 13th month salary bonus for teachers and lecturers who do not receive performance allowance or benefits. Teachers and lecturers whose basic salaries are paid from the state budget and who do not receive performance allowance are entitled to receive 50 percent of monthly teacher’s professional allowance / lecturer’s professional allowance.

“Teachers whose basic salary comes from APBD and who do not receive additional income can be given a maximum of 50 percent of the teacher’s professional allowance or a maximum of 50 percent of the additional income of state apparatus teachers received in one month,” stated the PP.

The regulation also regulates that the THR should be disbursed 10 days before Eid al-Fitr at the earliest.

“However, if it cannot be paid yet during that period, the allowance can still be paid after Eid,” the regulation stated.

Meanwhile, the 13th month salary bonus shall be paid in June, and in the event when the 13th month salary cannot be paid in June, the salary bonus will be disbursed after June 2023.

At the end of the regulation, it is stated that further provisions regarding technical process of the disbursement of holiday allowance and 13th month salary bonus in which the budget is sourced from APBN and APBD will be further regulated under regulation of a minister overseeing government affairs in the financial sector and regulation of regional head respectively.
