Gov’t Postpones 2020 Simultaneous Regional Elections

The Government has decided to postpone the 2020 elections of governor and deputy governor, regent and deputy regent, mayor and deputy mayor amidst the ongoing COVID-19 pandemic.

The decision was stated in Government Regulation in Lieu of Law (Perppu) Number 2 of 2020 on the Third Amendment to Law Number 1 of 2015 on Enactment of Government Regulation in Lieu of Law Number 1 of 2014 on Elections of Governors, Regents and Mayors signed by President Joko “Jokowi” Widodo on 4 May 2020.

The regulation also aims to maintain the quality of the elections and maintain national political stability.

Article 120 paragraph (1) of the Law has been amended into “in the event that unrest, security disturbance, natural disaster, non-natural disaster, or other disruptions occur in a part of electoral districts, all electoral districts, a large part of regions or all regions, which hamper a number of stages in an election or a simultaneous election, the postponed elections or the postponed simultaneous election shall be held. ‘

“The postponed elections or the postponed simultaneous election as referred to in paragraph (1) shall begin with the interrupted stage of the elections or the simultaneous elections,” Article 120 paragraph (2) of the regulation reads.

In the meantime, between Article 122 and Article 123, 1 (one) Article is inserted.

Article 122A paragraph (1) states that the postponed simultaneous elections as referred to in Article 120 shall be held after the General Elections Commission (KPU) issues a decree on postponement of the stages of the simultaneous election.

Article 122A paragraph (2) stipulates that the decision of the postponement of simultaneous election stages and the implementation of the postponed simultaneous election as referred to in paragraph (1) shall be held with a mutual agreement between the KPU, the Government and the House of Representatives (DPR).

“Further provisions regarding procedures and time for the implementation of the simultaneous election shall be regulated by the KPU Regulations,” Article 122A paragraph (3) reads.

Between Article 201 and Article 202, 1 (one) Article is inserted.

Article 201A paragraph (1) states that the simultaneous election as referred to in Article 201 paragraph (6) is postponed due to non-natural disasters as referred to in Article 120 paragraph (1).

“The postponed simultaneous election as referred to in paragraph (l) shall be held in December 2020,” Article 201A paragraph (2) states.

Article 201A paragraph (3) stipulates that in the event that the simultaneous election as referred to in paragraph (2) cannot be held, the simultaneous election shall be postponed and rescheduled immediately after the non-natural disaster as referred to in paragraph (1) ends through the mechanism as referred to in Article 122A.

“The Government Regulation in Lieu of Law shall come into force as of the date of its promulgation,” Article II of the Regulation reads.
