President Jokowi Issues Instruction on Acceleration of 11 Integrated Cross-Border Posts Development

President Joko “Jokowi” Widodo on 17 January, 2019 signed Presidential Instruction Number 1 of 2019 on Acceleration of Development of Eleven Integrated Cross-Border Post (PLBN) and Supporting Infrastructure Facilities in Border Area (link: Presidential Instruction Number 1 of 2019).

The Presidential Instruction is addressed to: 1. Coordinating Minister for Political, Legal and Security Affairs; 2. Minister of Home Affairs; 3. Minister of Defense; 4. Minister of Law and Human Rights; 5. Minister of Finance; 6. Minister of Health; 7. Minister of Trade; 8. Minister of Energy and Mineral Recourses; 9. Minister of Public Works and Public Housing; 10. Minister of Transportation; 11. Minister of Communication and Informatics; 12. Minister of Agriculture; 13. Minister of the Environment and Forestry; 14. Minister of Marine Affairs and Fisheries; 15. Minister of Village, Underdeveloped Regions and Transmigration; 16. Minister of Agrarian and Spatial Planning/Head of the National Land Agency (BPN).

Other government officials addressed by the Presidential Instruction are: 17. Minister of National Development Planning/Head of the National Development Planning Agency (Bappenas); 18. Commander of the Indonesian National Defense Forces (TNI); 19. Chief of the Indonesian National Police (Polri); 20. Head of the National Agency for Border Management (BNPP); 21. Governor of Riau; 22. Governor of West Kalimantan; 23. Governor of North Kalimantan; 24. Governor of East Nusa Tenggara; 25. Governor of Papua; 26. Regent of Natuna; 27. Regent of Bengkayang; 28. Regent of Sintang ; 29. Regent of Nunukan; 30. Regent of Malinau; 31. Regent of Kupang; 32. Regent of North Central Timor; 33. Regent of Merauke; and 34. Regent of Boven Digul.

The President instructs those officials to take measures in accordance with their respective duties, functions and authorities in a coordinated and integrated way to accelerate the construction of eleven Integrated PLBN, among others:

  1. Integrated PLBN of Serasan, Serasan District, Natuna Regency, Riau;
  2. Integrated PLBN of Jagoi Babang, Jagoi Babang District, Bengkayang Regency, West Kalimantan;
  3. Integrated PLBN of Sei Kelik, Ketungau Hulu District, Sintang District, West Kalimantan;
  4. Integrated PLBN of Sei Nyamuk, North Sebatik District, Nunukan Regency, North Kalimantan;
  5. Integrated PLBN of Labang, Lumbis Ogong District, Nunukan Regency, North Kalimantan;
  6. S Integrated PLBN of Long Midang, Krayan District, Nunukan Regency, North Kalimantan;
  7. 4 Integrated PLBN of Long Nawang, Kayan Hulu District, Malinau Regency, North Kalimantan;
  8. 4 Integrated PLBN of Oepoli, East Amfoang District, Kupang Regency, East Nusa Tenggara;
  9. Integrated PLBN of  Napan, North Bikomi District, North Central Timor Regency, East Nusa Tenggara;
  10. Integrated PLBN of Sota, Sota District, Merauke Regency, Papua; and
  11. Integrated PLBN of Yetetkun, Ninati District, Bovel Digul Regency, Papua.

The Presidential Instruction stipulates that Coordinating Minister for Political, Legal and Security Affairs shall provide general directions and supervision in development of the eleven integrated PLBN, while Minister of Home Affairs shall accelerate the completion of State-Owned Property (BMN)/Regional-Owned Property of the integrated PLBN.

The Presidential Instruction also instructs Minister of Defense to formulate the Integrated PLBN security policy and instructs Minister of Law and Human Rights to provide personnel and immigration facilities in the Integrated PLBN. “Minister of Finance shall prepare accelerated steps for transferring BMN status and provide customs personnel and facilities in the Integrated PLBN,” the Presidential Instruction reads.

The Presidential Instruction also requires Minister of Health to provide personnel and facilities for quarantine in the Integrated PLBN and provide personnel and health service facilities in the Integrated PLBN. It also states that Minister of Trade shall stipulate regulations and/or guidelines for the implementation of cross-border trade and provide and/or revitalize markets in border areas.

“Minister of Energy and Mineral Resources shall accelerate the provision of electricity facilities and infrastructure as well as the availability of fuel in the Integrated PLBN and its surroundings,” the Presidential Instruction reads.

In the meantime, the Presidential Instruction also instructs Minister of Public Works and Public Housing to: a. compile master plan of the Integrated PLBN in accordance with typology of the PLBN; b. accelerate the construction of buildings and provide facilities to support cross-border inspection and service in the Integrated PLBN; c. provide housing and other supporting facilities for Integrated PLBN managers, customs officials, immigration personnel, quarantine personnel, and border area security personnel.

The Minister of Public Works and Public Housing is also instructed to provide supporting facilities to support the Integrated PLBN in the form of housing, markets, places of worship, drinking water supply, waste management, and construction of access roads and main roads from/to the Integrated PLBN area.

The Presidential Instruction also instructs Minister of Transportation to provide personnel and build facilities and modes of transportation in the Integrated PLBN and the surrounding areas and  build passenger transit terminal and international goods terminal in the Integrated PLBN area along with the supporting facilities.

Minister of Communication and Informatics is instructed by the President to build telecommunication and information transmitters and networks in the Integrated PLBN and the surrounding areas and to provide quality data/internet communication facilities in the Integrated PLBN and the surrounding areas.

“Minister of the Environment and Forestry shall accelerate the settlement of land issues related to the status of the area,” the Presidential Instruction reads.

The Presidential Instruction also instructs Minister of Agrarian and Spatial Planning/Head of the National Land Agency (BPN) to: a. accelerate the process of adjusting spatial planning and synchronize detailed spatial planning in the Integrated PLBN area; b. facilitate the procurement of land for the construction of the Integrated PLBN and supporting areas; and c. completing the administration of land registration for the construction of the Integrated PLBN and supporting area.

The Presidential Instruction further instructs Minister of National Development Planning/Head of the National Development Planning Agency to coordinate the development and budgeting of the Integrated PLBN, while Head of the National Border Management Agency (BNPP) is instructed to: a. determine  typology of the Integrated PLBN; b. complete master plan of the integrated PLBN development; c. coordinate the construction of the Integrated PLBN in accordance with typology and master plan; d. evaluate and oversee the Integrated PLBN development and supporting facilities; and e. provide institutional support and personnel for the Integrated PLBN.

The Presidential Instruction also instructs  Governors of Riau, West Kalimantan, Central Kalimantan, East Nusa Tenggara, and Papua provinces as well as the Regents to: a. facilitate the acceleration of the development of the Integrated PLBN; and b. coordinate and facilitate the transfer of assets of Regional-Owned Property and/or State-Owned Property. The Presidential Instruction also instructs the Regents to accelerate the licensing process for the development of the Integrated PLBN.

“The aforementioned Government Ministries/Agencies shall achieve breakthrough in order to accelerate the completion of the Integrated PLBN no later than one year from the issuance of this Presidential Instruction,” the third dictum of the Presidential Instruction reads.

The accelerated development of the Integrated PLBN and supporting infrastructure facilities, according to this Instruction, is financed by State Budget, Regional Budget, and other non-binding sources in accordance with the provisions of law.

The Presidential Instruction was enacted on 17 January 2019 and shall come into force on the date of its promulgation. (Pusdatin/ES).
