President Jokowi Signs Presidential Instruction on Accelerated Complete Systematic Land Registration
In a bid to register all parcels of land in the Unitary State of the Republic of Indonesia as mandated in Article 19 of Law Number 5 of 1960 on Basic Agrarian Principles, the Government launched a program to accelerate Land Registration through Complete Systematic Land Registration until 2025.
In order to implement the program, President Joko Jokowi Widodo on 13 February 2018 has signed Presidential Instruction Number 2 of 2018 on the Acceleration of Complete Systematic Land Registration to all parcels of land in the Republic of Indonesia.
The subjects of the Presidential Instruction are: 1. Minister of Agrarian and Spatial Planning/Head of National Land Agency (BPN); 2. Minister of Environment and Forestry; 3. Minister of Public Works and Public Housing (PUPR); 4. Minister of Home Affairs; 5. Minister of State-owned Enterprises; 6. Minister of Finance; 7. Minister of Villages, Disadvantaged Regions and Transmigration; 8. Indonesian National Police Chief; 9. Attorney General of the Republic of Indonesia; 10. Head of Government Procurement of Goods and Services Agency; 11. Head of National Institute of Aeronautics and Space; 12. Head of Geospatial Information Agency; 13. Governors; and 14. Regents/Mayors.
The President instructs the government officials to take necessary measures in accordance with their respective tasks, functions, and authorities in order to implement the acceleration of Complete Systematic Land Registration throughout Indonesia as a part of National Movement. The move is aimed at manifesting a complete land registration throughout Indonesia and to support National Strategic Projects.
President Jokowi particularly instructs the Minister of Agrarian and Spatial Planning/Head of BPN to perform land registry activities in complete, and systematic manners that classify the land in three criteria, among others: a. Cluster 1, means a parcel of land that meets the requirement of certificate issuance; 2. Cluster 2, means a parcel of land that is only registered on land register due to not meeting the requirements of certificate issuance because the parcel of land is in a state of dispute in court; 3. Cluster 3, means a parcel of land that is only registered on land register due to not meeting the requirements of certificate issuance because the subject or object does not comply with requirements to be given rights to land on the Complete Systematic Land Registration or its whereabouts is unknown.
In addition, the President instructs Minister of Agrarian and Spatial Planning/Head of BPN to create a regulation and take measures to accelerate the Complete Systematic Land Registration in a process of proof of ownership and / or possession of land; create / prepare / revise the Regulation that regulates the announcement date of physical and judicial data in order to accelerate the completion of Complete Systematic Land Registration; report the output of Complete Systematic Land Registration to One Map Policy Acceleration Team to strengthen the database of One Map Policy; and evaluate, monitor, and report the implementation of the Presidential Instruction periodically to the President of the Republic of Indonesia.
President Jokowi also instructs Minister of Environment and Forestry to submit the spacial data on a forest delineation in all regions throughout Indonesia to the Ministry of Agrarian and Spatial Planning/ BPN; assist physical and judicial data collecting officers of the Ministry of Agrarian and Spatial Planning/ BPN in regions that border with forest territory and sign the delineation; and make settlement measures with the Ministry of Agrarian and Spatial Planning/ BPN in a matter relating the use, utilization, possession, and ownership of community land located in forest territory in accordance with the mechanism in a Presidential Regulation that regulates settlement possession of land in the forest territory.
In that Presidential Instruction, the President instructs Minister of Public Works and Public Housing to provide information includes spatial data on Riparian Area, Lake/Reservoir/ Retention Basins (embung) Areas to the Ministry of Agrarian and Spatial Planning/ BPN; and assist the physical and judicial data collecting officers of the Ministry of Agrarian and Spatial Planning/ BPN in Riparian Area, Lake/Reservoir/ Retention basins (embung) Areas.
To Minister of Home Affairs, President Jokowi instructs him to facilitate Governors/Regents/Mayors in taking accelerating measures to the Complete Systematic Land Registration in accordance with the provisions of the law.
President Jokowi instructs Minister of State-owned Enterprises to encourage State-owned Enterprises to play an active role in accelerating the Complete Systematic Land Registration.
The President also instructs Minister of Finance to support the Complete Systematic Land Registration by individual owners by granting fiscal policy facility in the acceleration by giving people cost relief towards Stamp Duty and Income Tax that are in accordance with the provisions of the law.
Minister of Villages, Disadvantaged Regions and Transmigration will provide data about area set for transmigration location, the eighth dictum of the Presidential Instruction reads.
President Jokowi also instructs Governors and Regents/Mayors to support the implementation of the acceleration of Complete Systematic Land Registration by regulating, stipulating, and/or budgeting the required cost in preparation document in the implementation of Complete Systematic Land Registration in Village/Regencies based on the financial capability of the regions in accordance with the provisions of the law.
To all aforementioned government officials, the President instructs them to execute Presidential Instruction Number 2 of 2018 with full responsibility.
