President Jokowi Signs Presidential Instruction on COVID-19 Protocols Enforcement

President Joko “Jokowi” Widodo on 4 August 2020 signed Presidential Instruction (Inpres) Number 6 of 2020 on Maintaining Self-Discipline and Law Enforcement of Health Protocols in the Prevention and Control of COVID-19.

The Instruction aims to ensure legal certainty, strengthen efforts and increase the effectiveness of the prevention and control of COVID-19 in all regions in Indonesia,

In the Presidential Instruction, the President instructs Cabinet Ministers, Cabinet Secretary, Commander of the Indonesian National Defense Forces, Chief of the Indonesian National Police, Heads of Non-Ministerial Government Institutions, Governors, and Regents/Mayors to take necessary measures according to their respective duties, functions and authorities in ensuring legal certainty, strengthening efforts and increasing the effectiveness of the prevention and control of Corona Virus Disease 2019 (COVID-19) in all provinces and regencies/cities in Indonesia.

In the SECOND Dictum of the Instruction, the President instructs Coordinating Minister for Political, Legal and Security Affairs to:

  1. carry out coordination, synchronization and control over the implementation of maintaining self-discipline and law enforcement against violations of health protocols in the prevention and control of Corona Virus Disease 2019 (COVID-19); and
  2. report the implementation of the Presidential Instruction to the President not less than 1 (one) time in every 1 (one) month or any time if deemed necessary.

The President also instructs Minister of Home Affairs to:

  1. carry out massive dissemination on the implementation of health protocols in the prevention and control of Corona Virus Disease 2019 (COVID-19) to local governments and communities;
  2. provide technical guidelines to provincial governments and regency/city governments in drafting Governor/Regent/Mayor regulations;
  3. provide assistance to provincial governments and regency/city governments in drafting Governor/Regent/Mayor regulations;
  4. coordinate and synchronize the implementation of maintaining self-discipline and law enforcement against violations of health protocols in the prevention and control of Corona Virus Disease 2019 (COVID-19) in provincial and regency/city areas; and
  5. report the implementation of duties to the Coordinating Minister for Political, Legal and Security Affairs not less than 1 (one) time in every 1 (one) month or any time if deemed necessary.

The President also instructs Head of the National Agency for Disaster Mitigation (BNPB), as Chairperson of the COVID-19 Handling Task Force, to:

  1. carry out monitoring and evaluation of the implementation of the imposition of sanctions for violations of health protocols in the prevention and control of Corona Virus Disease 2019 (COVID-19) in provinces and regencies/cities; and
  2. report the implementation of monitoring and evaluation to Chairperson of the Policy Committee of Corona Virus Disease 2019 (COVID-19) and the National Economic Recovery Committee not less than 1 (one) time in every 2 (two) weeks or any time if deemed necessary.

The President also instructs Commander of the Indonesian National Defense Forces to:

  1. provide support to Governors, Regents/Mayors by mobilizing personnel of the Indonesian National Defense Forces to supervise the implementation of health protocols in communities; and
  2. intensify patrolling the implementation of health protocols in communities, together with Chief of the Indonesian National Police and other agencies, as well as local governments; and
  3. conduct community development to improve participation in measures to prevent and control Corona Virus Disease 2019 (COVID-19).

The President also instructs Chief of the Indonesian National Police, to:

  1. provide support to Governors, Regents/Mayors by mobilizing personnel of the Indonesian National Police to supervise the implementation of health protocols in communities;
  2. intensify patrolling the implementation of health protocols in communities, together with Commander of the Indonesian National Defense Forces and other agencies, as well as local governments; and
  3. conduct community development to improve participation in measures to prevent and control Corona Virus Disease 2019 (COVID-19).
  4. streamline law enforcement measures against violations of health protocols.

At the end of the SECOND Dictum, the President instructs Governors, Regents and Mayors to:

  1. massively intensify dissemination on implementation of health protocols in the prevention and control of Corona Virus Disease 2019 (COVID-19) by involving communities, religious leaders, traditional leaders, community leaders, and other community members;
  2. draft and issue Governor/Regent/Mayor regulations;
  3. take into account the local wisdom of each region in drafting and issuing Governor/Regent/Mayor regulations as referred to in letter b;
  4. coordinate with related Ministries/Agencies, the Indonesian National Defense Forces, and the Indonesian National Police in imposing the sanctions.

“The implementation the Presidential Instruction is funded by the State Budget, Regional Budget, and other legal and not binding sources in accordance with provisions of laws and regulations,” THIRD Dictum of the Presidential Instruction reads.

In accordance with the FOURTH Dictum of the Presidential Instruction, the aforementioned officials should implement this Instruction very responsibly.

“The Presidential Instruction shall apply as of the date of its issuance,” the Presidential Instruction reads. (EN)
