Government Regulation Number 41 of 2020

President Joko “Jokowi” Widodo on 24 July 2020 signed Government Regulation Number 41 of 2020 on the Transfer of Status of the Corruption Eradication Commission (KPK) Employees to State Civil Service Apparatus (ASN) Employees.

This Government Regulation is an initiative of Ministry of State Apparatus Empowerment and Bureaucratic Reforms.

According to Presidential Spokesperson for Legal Affairs Dini Purwono in a release on Monday (10/8), the Government Regulation constitutes an implementation of the mandate of the KPK Law Article 1 number 6, Article 69B, and Article 69C.

The Government Regulation stipulates that KPK employees are ASN and in the event that KPK employees are not yet ASN within a period of no later than 2 two years from the second revision to the KPK Law promulgated on 17 October 2019, the employees may be appointed as ASN so long as they meet the requirements, she added.

Dini also pointed out that the issuance of this Government Regulation is expected to create an orderly state administration.

“This Government Regulation will not compromise the KPK independence as Article 3 of the KPK Law states that the KPK remains independent and free from the influence of any power. There is absolutely no intention from the Government to weaken the KPK in this matter. Instead, this is part of strengthening the institution to fight against corruption in Indonesia,” she said.

The designation is made once the new KPK organizational structure and work procedures have been established, according to the release. (SKP for Legal Affairs/EN)
