Presidential Regulation 75/2019 Stipulates BPJS Premium Increase

President Joko “Jokowi” Widodo on 24 October 2019, signed Presidential Regulation (Perpres) Number 75 of 2019 on Amendments to Presidential Regulation Number 82 of 2018 on Health Insurance. The Amendment aims to improve the quality and sustainability of the health insurance program.

The Regulation amends Article 29 so that it reads: 1. Premium for PBI (subsidy beneficiaries) and the people registered by the Regional Government is Rp42,000.00 (forty-two thousand rupiah) per person per month. 2. The premium increase shall apply as of 1 August, 2019.

The premium for PPU (wage-recipient workers) consisting of state officials, speakers and members of the Regional House of Representatives, civil servants, the Indonesian National Defense Forces (TNI) personnel, the Indonesian National Police (Polri) personnel, village heads and village apparatus, and employees are 5% (five percent) from salary or wages per month.

“The aforementioned premium is paid with the following conditions: a. 4% (four percent) of the premium is paid by employer; and b. 1% (one percent) of the premium is paid by participants,” article 30 paragraph (2) of the Regulation reads.

The obligation of the Employer in paying premium, according to the Regulation, is under the responsibility of: a. Central Government for premium of state officials, civil servants of the Central Government, the Indonesian National Defense Forces (TNI) personnel, the Indonesian National Police (Polri) personnel, and employees of Central Government Agencies; and b. Regional Government for premium of regional heads and deputy regional heads, speakers and members of the Regional House of Representatives, regional civil servants, village heads and village apparatus, and employees of regional agencies.

“The premiums are paid directly by the employer to the Healthcare Security Provider Body (BPJS Kesehatan) through the state treasury except for village head and village apparatus,” article 30 paragraph (4) of the Regulation reads.

The Regulation also stipulates that salaries or wages used as the basis for calculating premiums for state officials, speakers and members of the Regional House of Representatives, civil servants, the Indonesian National Defense Forces (TNI) personnel, and the Indonesian National Police (Polri) personnel consist of basic salaries or wages, family allowances, job allowances or general allowances, professional allowances, and performance allowances or additional income.

The salary or wages used as the basis for calculating premiums for village heads and village apparatus as well as employees are based on fixed income.

“The salary or wages used as the basis for calculating premiums for PPU participants other than the aforementioned participants consist of basic salary and permanent allowances, which are paid to workers without taking into account the presence of workers,” article 33 paragraph (3,4) of the Regulation reads.

Provisions regarding the percentage, the highest limit of salary or wages per month, and the basis for premium calculation for state officials, speakers and members of the Regional House of Representatives, civil servants, the Indonesian National Defense Forces (TNI) personnel, the Indonesian National Police (Polri) personnel, and employees of the Central Agencies, according to the Regulation, shall apply as of 1 October 2019.

While the provisions regarding: a. the percentage, the highest limit of salary or wages per month, and the basis for premium calculation for regional heads and deputy regional heads, speakers and members of the Regional House of Representatives, regional civil servants, village heads and village apparatus, and employees of regional agencies; and b. the highest limit of salary or wages per month for private sector employees shall apply as of 1 January 2020.

The Regulation further stipulates that premium for PBPU (non-wage recipient workers) and BP (non- workers) are: a. Rp42,000.00 (forty two thousand rupiah) per person per month for 3rd class hospital ward; b. Rp110,000.00 (one hundred and ten thousand rupiah) per person per month for 2nd class hospital ward; or c. Rp160,000.00 (one hundred and sixty thousand rupiah) per person per month for 1st class hospital ward.

“The aforementioned premium shall apply on 1 January 2020,” article 34 paragraph (2) of the Regulation reads.

The Presidential Regulation was promulgated by Minister of Law and Human Rights Yasonna H. Laoly on 24 October 2019. The Regulation shall apply as of the date of its promulgation. (Pusdatin/ES)
