Presidential Regulation Number 167/2014: All Governor Inaugurated by President in the Capital of State
By the consideration to conduct regulations in the Article 165 of Government Regulations in a Lieu of a Law Number 1 of 2014, on November 18, 2014, President Joko Widodo (Jokowi) had signed the release of Presidential Regulations Number 167 of 2014 regarding the Procedure of Governor, District Head, and Mayor Inaugurations.
The article 3 of this Presidential Regulations mentioned that the official who inaugurates Governors is the President. In case the President is unable to do the inauguration, he will be replaced by the Vice President. And in case the President and Vice President are unable either, then the inauguration will be conducted by the Home Minister.
As for the official who inaugurates the District Head and Mayor is the Governor. In case the Governor is unable then it will be conducted by the Vice Governor.
In case the Governor and Vice Governor are unable to do the inauguration, then it will be conducted by the Home Minister, as written in Article 4 Verse (3) of the regulation.
The Governors Inauguration is conducted in the capital of the state, while the District Head and Mayor is conducted in the capital of the province.
The Inauguration of the Governor is conducted by inviting the leaders of Regional House of Representatives in Province, and the inauguration is conducted by inviting the leaders of Regional House of Representatives in District/City, as written in Article 5 Verse (2) of Presidential Regulation Number 167/2014.
This Presidential Regulation affirms the procedure of Governor Inauguration is based on presidential protocol. While for the inauguration of District Head and Mayor may be added with the reading of the sacred verses of Al-Quran or particular religious ceremony or local wisdom values believed by the District Head or Mayor.
The handover for the Governor is conducted in the capital of the province, and for the positions of District Head and Mayor are conducted in the capital of district/city, witnessed by the Home Minister of the appointed official.
Governor, District Head, and Mayor Officials
For the positions of Governor, according to the Presidential Regulation Number 167 of 2014, the one who inaugurates them is the Minister on behalf of the President. The inauguration is held in the capital of the state.
The inaugurations of District Head and Mayor are conducted by the Governor on behalf of the President that is conducted in the capital of province.
The official who inaugurates the Governor, District Head, and Mayor in the new autonomy regions and/or preparation regions for the first time is the Home Minister on behalf of the President, as written in Article 13 Verse (5) of the Presidential Regulation.
The Article 17 of the Presidential Regulation affirmed that the regulation of the Presidential Regulation is valid for the inauguration implementation in the Provinces of Aceh, Special Region of Capital Jakarta, Special Region of Yogyakarta, Papua, and West Papua, as long as not differently regulated in the different Law.
This Presidential Regulation is applied as of its enactment, as written in the Presidential Regulation signed by Minister of Law and Human Rights Yasonna H. Laoly. (Pusdatin/ES)
